The dispute over the telephone between Elisha Gray and Alexander Graham Bell centers on whether they each arrived at the invention independently. This is a more specific question than who should be credited with inventing the telephone overall, as several other people also have claims. The disagreement involves the actions of the inventors' lawyers, how patent documents were filed, and accusations of stolen ideas.

Bell, a professor of elocution at Boston University who also taught deaf children, began experimenting with electricity in Scotland in 1867. After moving from Canada to Boston, he worked on a "harmonic telegraph" that could send multiple messages over a single wire. To fund this research, he partnered with the parents of two of his students, including Boston lawyer Gardiner Hubbard, in exchange for a share of future profits. Between 1872 and 1876, Bell tried many different transmitters and receivers, made numerous drawings of liquid transmitters, and received a patent in 1875 for an early fax machine that used them—drawings of which were published by the U.S. Patent Office.

Gray, a well-known inventor based in Highland Park, Illinois, ran Western Electric, a major supplier to Western Union. By 1874, Bell and Gray were competing to be the first to create a practical harmonic telegraph. That summer, Gray built a device using vibrating reeds that could transmit musical tones but not speech, and he demonstrated it publicly in December 1874 at a church in Highland Park. After setting this work aside, Gray drew a diagram for a telephone in his notebook on February 11, 1876. Three days later, his lawyer filed a patent caveat with a similar diagram. On that same day, Bell's lawyer hand-delivered a patent application for the harmonic telegraph, which also covered transmitting vocal sounds. On February 19, the Patent Office suspended Bell's application for three months so Gray could submit a full patent application with claims, after which an interference proceeding would determine who invented the telephone first. At the time, the Patent Office did not require a working model for a patent application, but the process often took years, and interference hearings were public. Congress had ended the model requirement in 1870.

The affidavit was drawn up by lawyers for the Pan-Electric Telephone Company, which was being sued by Bell Telephone for patent infringement and was under congressional investigation. Bell swore he never gave any money to Wilber and that Wilber did not show him Gray's caveat or any drawing of it.
